I spend the first ten minutes of each day blocking IP’s that try to hack my server and sorting out junk email from fraudulent websites. It is annoying and presents a risk for hosting servers that do not monitor such actions. With that in mind, I can certainly understand why the Department of Homeland Security and the FBI would want to shut down websites that pose a fraudulent risk to consumers. However, I believe I have serious concerns about these Government organizations’ ability to seize domains at will. What ‘committee’ makes these decisions? According to this article from NPR, “The Justice Department has 60 days to notify the owners of the websites about the seizures in case the owners want to challenge the effort in court. But criminal division chief Lanny Breuer said virtually all such takeovers become permanent.” The first question that comes to my mind is how did this begin and where does it end? Or does it?
Secondly, is this Constitutional since no guilt has been found before the action is taken?
